New Law on AIDS of the Republic of Moldova
Recognizing the necessity to improve the legislative framework related to the HIV and AIDS area in Moldova, the Ministry of Health and Social Protection has initiated the process of the development of the a new Law on AIDS. Efforts have been undertaken to involve the civil society in the consultation process in order to ensure ownership, adequate response, and efficiency. The detailed consultation process, available drafts and announcements are presented below.

The Law number 23-XVI "On HIV/AIDS Infection Prevention" adopted by the Parliament of the Republic of Moldova on February 16, 2007 was published in the official law register Monitorul Oficial.

February 16, 2007
The Parliament of the Republic of Moldova has adopted the Law on HIV infection. This law includes provisions about social assistance, treatment, as well as voluntary counselling and testing. The law also clearly stresses that people living with HIV may not be discriminated. One of the major changes made after the first reading was the elimination of the provisions with respect to populations most likely to be exposed to HIV such as sex workers, men having sex with men, and injecting drug users. The law is going to take effect as soon as it is published in Monitorul Oficial.


November 23, 2006
Approval in the first hearing in the Parliament of the draft Law on AIDS, presented by the Parliamentary Commission for Social Protection, Health and Family. The draft Law was approved unanimously. Article 5, points 1, 7, 8 and 9, and Article 29 was substantially debated.


November 16, 2006, 10:00
First hearing in the Parliament of the draft Law on AIDS, presented by the Parliamentary Commission for Social Protection, Health and Family. Comments and suggestions from NGO sector and international organizations are expected to follow. Hearing was re-scheduled for a latter date due to a delay in the meeting agenda.


November 15, 2006, 17:00
UN Joint Team meeting discussed the draft Law on AIDS and added comments and suggestions. The latter were incorporated in the draft and a letter to the Parliamentary Commission for Social Protection, Health and Family was drafted as well.Letter to Parliamentary Committee on behalf of UN [96Kb] / RO


October 18, 2006
Igor Chilcevschii, Director of NGO of PLHIV "Credinta" and member of NCC has met with Mrs. Valentina Buliga, President of Parliamentary Commission for Social Protection, Health and Family and Mrs. Valentina Golban, Deputy of this Commission. The meeting discussed the Concept of Cooperation between the Parliament of the Republic of Moldova and civil society. Together with other members of civil society, suggestions as to the changes in the draft Law on AIDS have been presented.

Draft Law on AIDS is approved by the Government and is forwarded to the Parliament for further examination (Government Decision nr. 909, adopted on August 9, 2006, published in Monitorul Oficial nr. 131 from August 18, 2006 article 976).

December 28, 2005
The draft Law on AIDS was discussed at the II Workshop for Monitoring the Resolution of the I National Forum of NGOs working in the Field of HIV/AIDS and TB from Moldova. The Secretariat of the AIDS Network has compiled and introduced suggestions and comments to the draft on behalf of civil society. To note that representatives of civil society from Transdniestria have also attended this workshop.

2nd draft – Additions and changes have been made by the UN Theme Group on HIV/AIDS, government partners and other stakeholders.

1st draft – UNAIDS has hired an independent legal consultant to develop the first draft of the new Law on AIDS based on the international best practice, and in compliance of current legal norms, procedures and situation.
